The difference is that Toblerone is a brand name. Gruyere is a specific product which can be made anywhere. If the brand isn't made in Switzerland, it's not Swiss! That makes perfect sense. No ones trying to pretend that American Gruyere is made in Switzerland.
That reminds me, I love Gruyere cheese. I just discovered it recently and it's the best!

Gruyere is a specific product which can be made anywhere. That's the difference of opinion - US law allows US companies to steal brand value that others have created. EU law doesn't.
