The problem is empty prisons aren't considered a sign of success. Where some might see little to no crime being committed to fill the prisons, others just see lost revenue. Filled prisons justify a whole ecosystem of labour from wardens to guards to people who supply to food and linens. The economic well-being of society at large and thousands of employees connected to the prison system is staked on keeping them populated by any means necessary. No prisoners = no revenue stream.
