It was a logistical nightmare from the beginning.
By letting the Osundairo brothers go, the police basically admitted it wasn't a big deal.
If it's not a big deal for the Osundairos to receive payment, buy the supplies, and commit the act, then it's not a big deal for Smollett to pay them to do it and report it.
MAGA needed to let it go, but couldn't.

Terrible analogy. Killing someone is a very serious crime, regardless of if you were the person who pulled the trigger, or the one who paid to have the trigger pulled. In the Jussie Smollett case, the crime is the false reporting to the police, not the staging of it. There is no problem at all with letting the brothers go in exchange for their confession while charging the Smollett with false reporting and wasting police resources.

The crime is all of it.
If Smollett says he was attacked by MAGA, and there's no evidence of it, it doesn't go anywhere.
If there's evidence of it happening, there's now something to investigate, and hundreds of thousands of dollars are spent.
Without the staging, there's no evidence, and no extensive investigation.
That's why Smollett's initial punishment wasn't all that harsh.
But the people who were upset at him the most (fine I won't say MAGA) needed something more, and kept pushing for further punishment.
